Liner Terms of Service
Last updated
1. General provisions
1.1. These Terms of Service (the "Terms") govern the relationship between the administration of the Liner service (the "Operator", "we") and the individual (the "User") who uses the Liner service (the "Service").
1.2. The Service includes the Liner desktop app (Windows, macOS, Linux), the Liner mobile app (Android, iOS), the server side, the websites on the tryliner.tech domain and its subdomains, as well as updates and documentation.
1.3. These Terms are a public offer. The User accepts them in full and without reservation by doing any of the following: installing and launching the app, registering an account, signing in to an account or otherwise using the Service.
1.4. If the User does not agree with these Terms, they must stop using the Service and delete the app.
1.5. The Privacy Policy published in the Service and on the tryliner.tech website is an integral part of these Terms.
2. Definitions
Account — the User's account, created at registration with an email address and password.
Client — the Liner desktop or mobile app on the User's device.
User Content — everything the User creates in the Service: username, display name, avatar, profile description, playlist titles and descriptions.
Third-party sources — external services that the Client or the Service contacts: Discord, Spotify, Apple Music, Deezer, SoundCloud, lyrics providers and others.
Service Materials — the Service's program code, design, graphics, texts, logos and database.
3. What the Service is
3.1. Liner is a music player with synced lyrics, listening history, playlists, recommendations, leaderboards and social features (profiles, follows, online status).
3.2. Music is played from the Service's own library of tracks. The availability and contents of the catalog are determined by the Operator and may change over time.
3.3. Lyrics are provided by third-party providers and by the Service's own catalog. The rights to lyrics belong to their respective rights holders.
3.4. The core features of the Service are free. Additional features are available with the paid Liner Plus subscription (section 10).
3.5. The Operator may change the Service's feature set, add, modify and disable features, and may shut down the Service entirely with at least 30 days' notice.
4. Account
4.1. An Account is required to access the core features. To register, the User provides a valid email address, a password, a username and a display name.
4.2. The User warrants that they are at least 13 years old and have the legal capacity to enter into these Terms.
4.3. One User, one Account. Creating multiple accounts to get around the Service's limits is prohibited.
4.4. The User is responsible for keeping their password safe and for all actions taken under their Account. Any suspected unauthorised access must be reported immediately to hkamoric@gmail.com.
4.5. A username must not be misleading as to identity (impersonating other people, brands or the Service administration) and must not contain insults.
4.6. The User may delete their Account by sending a request to hkamoric@gmail.com from the address linked to the Account. Deletion is irreversible.
5. Rules of use
5.1. The User agrees to use the Service only for personal, non-commercial purposes and in accordance with applicable law and the rules of the Third-party sources.
5.2. It is prohibited to:
collect data from the Service by automated means (parsing, scraping, bulk API requests), including lyrics, profiles and other users' history;
circumvent rate limits, quotas and other technical protection measures;
use the Service through modified clients, scripts or bots, except where permitted by the source code license;
resell, rent out or provide access to the Service to third parties for a fee;
upload User Content that breaks the law, infringes the rights of third parties, or contains insults, pornography, or promotion of violence or discrimination;
impersonate another person or mislead other users;
interfere with the operation of the Service, or search for and exploit vulnerabilities without the Operator's approval;
use the Service to infringe the rights of music and lyrics rights holders.
5.3. The User is solely responsible for the lawful use of Third-party sources, including compliance with their terms and territorial restrictions.
6. User Content and visibility
6.1. The User retains the rights to their Content. By posting it, the User grants the Operator a free, non-exclusive license to store, display and reproduce it within the Service for as long as the Account exists and to the extent necessary for the Service to operate.
6.2. By default, the profile, current activity, listening history and participation in leaderboards are visible to other users. The User controls this in the privacy settings. Details are in the Privacy Policy.
6.3. The Operator is not obliged to review User Content in advance, but may remove Content that violates these Terms without notice.
6.4. The "Share" feature creates public links to tracks, albums, artists and playlists on the link.tryliner.fun domain. Such links are accessible to anyone who has them.
7. Playlist import
7.1. The Service lets the User import playlists by link from Third-party sources. The User confirms that they are entitled to use the contents of the imported playlist and that accessing it does not violate the terms of the respective source.
7.2. Import works by matching titles and artists. The Operator does not guarantee accurate matching or a complete import.
8. Third-party sources
8.1. The Service depends on Third-party sources that the Operator does not control. Their availability, quality, contents and terms of use are determined by their owners.
8.2. By using features that involve Third-party sources, the User agrees to their terms. In particular: for displaying status in Discord, the Discord terms.
8.3. The Operator is not responsible for Third-party sources ceasing or changing their operation, or for any resulting unavailability of the Service's features.
9. Intellectual property
9.1. The Service Materials belong to the Operator and its licensors and are protected by intellectual property law.
9.2. The Client source code is available under the Liner Source-Available & Non-Commercial Contribution License. Use of the code is governed by that license, not by these Terms. The license grants no rights to the "Liner" name, logos or the Service's server side.
9.3. The rights to music recordings, lyrics, artwork and metadata belong to their respective rights holders. The Service grants the User no rights to them other than the right to listen for personal purposes within the Service.
9.4. If the User believes that the Service infringes their intellectual property rights, they may send a notice to hkamoric@gmail.com describing the work, indicating where the infringement occurs and providing proof of rights.
10. Liner Plus paid subscription
10.1. The core features of the Service (playback, lyrics, playlist import) are free. Additional features are available with the paid Liner Plus subscription (the "Subscription").
10.2. The contents, price and term of the Subscription are published in the "Pricing" section of the tryliner.tech website (https://tryliner.tech/#pricing) and form part of these Terms. As of the date of this version, the Subscription costs 4 US dollars for 1 (one) month; taxes of the User's country are added to this amount at checkout. The final amount is shown to the User before payment.
10.3. The Subscription is issued only to an Account. Before paying, the User signs in to an Account or creates one on the tryliner.tech website or in the Client. The Account's email address is used to contact the User about payments and refunds. Payments are listed in the "Account" section of the tryliner.tech website.
10.4. Payments are accepted through payment providers using the methods available at the time of payment. The User enters payment details on the provider's side; the Service does not receive or store them.
10.5. The Subscription starts once the payment provider confirms the payment and lasts for the paid period. Renewal terms are shown at checkout.
10.6. When the Subscription ends, the User's data is not deleted. Library items above the free limits stay available read-only, and profile customization that requires the Subscription is hidden and restored on resubscribing.
10.7. Cancellation and refunds are governed by the Refund Policy (https://tryliner.tech/legal/refund-policy), which forms part of these Terms. It does not limit the User's rights under consumer protection law.
10.8. The User agrees not to initiate a payment dispute (chargeback) with their bank or payment provider without first contacting the Service's support. An unjustified chargeback is grounds for restricting access under section 12.
10.9. Features that are free on the date the User registers will not become paid without at least 30 days' notice. The Operator gives at least 30 days' notice of any change to the Subscription price; a change does not affect a period already paid for.
11. Disclaimer of warranties and limitation of liability
11.1. The Service is provided "as is" and "as available". The Operator does not guarantee uninterrupted or error-free operation of the Service, the safety of User Content, the accuracy of lyrics, recommendations and statistics, or that the Service will meet the User's expectations.
11.2. The Operator is not liable for:
losses, including lost profits, caused by the use of or inability to use the Service;
acts and omissions of Third-party sources;
loss of data due to actions of the User or third parties, or failures of the User's equipment;
the contents of other users' Content.
11.3. In any event, the Operator's liability is limited to the amount paid by the User for paid features of the Service during the 12 months before the claim arose, and to zero for free use, unless otherwise mandatorily required by law.
11.4. The limitations in this section do not apply to liability that cannot be excluded by law, including liability for intentional harm.
12. Suspension and termination of access
12.1. The Operator may restrict, suspend or terminate the User's access to the Service, including deleting the Account, in the event of a breach of these Terms, detected abuse or as required by law. In the case of a material breach, this may be done without prior notice.
12.2. Technical limits (rate limits, lyrics quotas) are applied automatically and do not constitute a suspension of access.
12.3. The User may stop using the Service and delete their Account at any time (clause 4.6).
12.4. Termination of access does not release the User from liability for breaches committed earlier.
13. Changes to these Terms
13.1. The Operator may change these Terms. The new version is published at the same address together with its effective date.
13.2. The Operator gives notice of material changes in the Client or by email at least 7 days in advance.
13.3. Continued use of the Service after the changes take effect means acceptance of the new version. If the User does not agree, they stop using the Service.
14. Governing law and disputes
14.1. These Terms are governed by the law of the Operator's place of business, subject to the mandatory consumer protection rules of the User's country of residence.
14.2. The parties will seek to resolve disputes through negotiation. A claim is sent to hkamoric@gmail.com; the response period is 30 days.
14.3. A dispute that is not resolved is referred to a court in accordance with applicable law.
14.4. If any provision of these Terms is held invalid, the remaining provisions remain in effect.
